Dear Colleagues —

In breaking news yesterday, the Department of Health and Human Services has sent recommendations to the DEA to reschedule marijuana as a Schedule III substance. Currently, marijuana is Schedule I. This action was taken pursuant to an October 2022 request letter from President Biden asking the Secretary of HHS and the Attorney General to review how marijuana is currently scheduled under federal law.

The immediate effect was a jump in publicly traded cannabis stocks. Whether this will have any effect on FDA’s views with respect to the status of CBD/hemp extracts remains to be seen.
