Court halts company's sale of DMAA products

While FDA remains embroiled in a court fight with Hi-Tech Pharmaceuticals over the regulatory status of DMAA supplements, a federal judge in California has issued a permanent injunction against distributor VivaCeuticals (Regeneca WorldWide) prohibiting the sale of products adulterated with DMAA and other unapproved drugs, such as PDE-5 and sildenafil. The company reached an agreement with the Department of Justice but is awaiting federal approval. Read more→

Reckitt Benckiser Group has agreed to acquire Mead Johnson Nutrition, a pediatric nutrition company, in a deal valued at $17.9 billion. Nutrition continued to be a hot category for acquisition in 2016, according to Nutrition Capital Network, which identified top M&A transactions and equity financings for the year. Notable deals included Dr. Peppers’ acquisition of Bai Brands and PepsiCo’s purchase of probiotics brand KeVita. NCN also said that valuations continued to increase in 2016 with the average multiple of sales at more than 3.0. Read coverage:

USANA Health Sciences Inc. finished 2016 with another quarter of solid top-line performance and Associate growth as net sales surged 9.5 percent to a record $1 billion. LifeVantage Corporation reported results for its second quarter of 2017 down 5.9 percent to $48.9 million, noting the performance was consistent with expectations as implementation of international policies disrupted sales. Hawaii-based astaxanthin and spirulina manufacturer Cyanotech reported a slight rise in sales but an increase in net loss in a recent earnings report. Health Canada has received more than 3,500 written comments in response to its proposed changes to how natural health products and dietary supplements are regulated, including a new structure classifying products based on risk. Former USDA Secretary Kathleen Merrigan warns that dark forces in the form of the Freedom Caucus, the GOP House members known for shutting down the government and pushing to repeal the ACA, is now setting its sights on certified organic food. She believes that dismantling the NOP would generate massive chaos in the food market and leave consumers completely confused about what organic means. Doing so may prompt a fight from young consumers who are the most avid organic buyers, according to a new report from the Organic Trade Association.
