FDA Cosmetic Safety & Modernization Act -- Introduction by Senator Hatch

​Dear Colleagues --

I attach the link to a bill recently introduced by Senator Hatch to modernize the regulation of cosmetics. As a growing percent of UNPA members are in the cosmetic and personal care sector, this bill will be of interest. In speaking with the Hatch staff, we can share the following:
​
  1. Senators Feinstein (D-CA) and Senator Hatch (R-UT) and their respective staffs have been in discussions with respect to an update of cosmetic safety.

  2. This bill takes into account a number of concerns such as managing and reporting serious adverse events, a revision of the adulteration standard for cosmetics, updated labeling requirements, registration of cosmetic facilities, establishment of GMPs, and a cosmetic ingredient review process.

  3. Very importantly, this bill also includes a preemption provision under which no state or local government could establish or maintain laws, regulations, or orders inconsistent with this act (think California), and a third party review process of cosmetic ingredients.

  4. Finally, the bill includes a requirement for a GAO report within two years of passage of this bill.
Cosmetic ingredient safety has been a significant issue, particularly from the State of California and a range of public interest groups.

On the view that this legislation is important to many of you, we will organize a conference call to receive your comments, which we will pass back to Senator Hatch's staff. As you know, tax reform is front and center right now, and we understand the Hatch staff is particularly busy right now. Hence, we will schedule a call and inform you of a proposed date shortly.
